Em 2010, o País produziu 195 mil toneladas de resíduos sólidos por dia, um aumento de 6,8% em relação a 2009, quando foram geradas 182.728 toneladas. Ao longo de 2010, o montante chegou a 60,8 milhões de toneladas de lixo. Dessas, 6,5 milhões de toneladas não foram coletadas e acabaram em rios, córregos e terrenos baldios. Do total de resíduos produzidos, 42,4%, ou 22,9 milhões de toneladas/ano, não receberam destinação adequada: foram para lixões ou aterros controlados (que não têm tratamento de gases e chorume). Os programas de coleta seletiva também não avançaram na mesma medida: dos 5.565 municípios brasileiros, 3.205 possuem alguma iniciativa de coleta seletiva. Embora 61% dos municípios brasileiros ainda destinem os resíduos de forma inadequada, os lixões têm data marcada para serem eliminados. A Política Nacional de Resíduos Sólidos (PNRS), regulamentada em dezembro de 2010, prevê a extinção dos lixões até 2014. O Projeto de Lei 1991/07, que instituiu a Política Nacional de Resíduos Sólidos, ficou parado no Congresso Nacional por 18 anos. A demora ocorreu por conta de uma série de emendas recebidas ao longo dos anos e da falta de consenso entre representantes dos setores público e privado. A aprovação do PL no Senado ocorreu em julho de 2010 e, em dezembro, ele foi regulamentado pelo então presidente, Luiz Inácio Lula da Silva. Art. 182 – Cabe ao Poder Público, através de seus órgãos de administração direta, indireta e fundacional: I preservar e restaurar os processos ecológicos essenciais das espécies e dos ecossistemas; II preservar e restaurar a diversidade e a integridade do patrimônio genético, biológico e paisagístico, no âmbito municipal, e fiscalizar as entidades de pesquisa e manipulação genética; III definir e implantar áreas e seus componentes representativos de todos os ecossistemas originais do espaço territorial do Município, a serem especialmente protegidos, sendo a alteração e supressão, inclusive dos já existentes, permitida somente por meio de lei, vedada qualquer utilização que comprometa a integridade dos atributos que justifiquem sua proteção. Ficam mantidas as unidades de conservação atualmente existentes. IV exigir, na forma de lei, para instalação de obra ou de atividade potencialmente causadora de significativa degradação do meio-ambiente, estudo prévio de impacto ambiental, a que se dará publicidade, garantidas audiências públicas, na forma da lei; V proteger a fauna e a flora, vedadas as práticas que coloquem em risco sua função ecológica, provoquem extinção de espécies ou submetam os animais a crueldade, fiscalizando a extração, captura, produção, transportes, comercialização e consumo de seus espécimes e subprodutos; VI proteger o meio-ambiente e combater a poluição em qualquer de suas formas; VII registrar, acompanhar e fiscalizar as concessões de direito de pesquisa e exploração de recursos hídricos e minerais em seu território; VIII definir o uso e ocupação do solo, subsolo e águas através de planejamento que englobe diagnósticos, análise técnica e definição de diretrizes de gestão dos espaços com participação popular e socialmente negociadas, respeitando a conservação de qualidade ambiental; IX estimular e promover o reflorestamento ecológico em áreas degradadas, objetivando especialmente a proteção de encostas e dos recursos hídricos, bem como a consecução de índices mínimos de cobertura vegetal; X controlar e fiscalizar a produção, a estocagem de substâncias, o transporte, a comercialização e a utilização de técnicas, métodos e as instalações que comportem risco efetivo ou potencial para a saudável qualidade de vida e ao meio-ambiente natural e de trabalho, incluindo materiais geneticamente acelerados pela ação humana, resíduos químicos e fontes de radioatividade. XI promover medidas judiciais e administrativas de responsabilização dos causadores de poluição ou de degradação ambiental; XII é vedada a concessão de recursos públicos ou incentivos fiscais às atividades que desrespeitem as normas e padrões de proteção ao meio-ambiente, natural ou de trabalho; Art. 183 - Aquele que explorar recursos minerais fica obrigado a recuperar o meio-ambiente degradado, de acordo com a solução técnica exigida pelo órgão público competente na forma em lei. Art. 184 - É proibida a instalação de reatores nucleares, com exceção daqueles destinados à pesquisa científica e ao uso terapêutico, cuja localização e especificações serão definidas em lei. Art. 185 - As condutas e atividades lesivas ao meio-ambiente sujeitarão os infratores a sanções administrativas com aplicação de multas diárias e progressivas nos casos de continuidade da infração ou reincidência, incluídas a redução do nível de atividade e a interdição, independentemente da obrigação dos infratores de restaurar os danos causados. ** Lei Orgânica Municipal ** Seção VI Dos Recursos Hídricos Art. 191 – O Município participará do sistema integrado do gerenciamento de recursos hídricos previsto no art. 205 da Constituição Estadual, isoladamente ou em consórcio com outros municípios da mesma bacia ou região hidrográfica, assegurando, para tanto, meios financeiros e institucionais. Art. 192 – Caberá ao Município no campo dos recursos hídricos: I instituir programas permanentes de racionalização do uso das águas destinadas ao abastecimento público e industrial e à irrigação, assim como de combate às inundações e à erosão, urbana e rural, e de conservação do solo e da água; II Estabelecer medidas para proteção e conservação das águas, superficiais e subterrâneas, e para sua utilização racional, especialmente daquelas destinadas a abastecimento público; III Proceder ao zoneamento das áreas sujeitas a riscos de inundações, erosão e escorregamento do solo, estabelecendo restrições e proibições ao uso, parcelamento e a edificações nas impróprias ou críticas, de forma a preservar a segurança e a saúde públicas; IV Ouvir a defesa civil a respeito da existência, em seu território, de habitações em áreas de risco, sujeitas a desmoronamentos, contaminações ou explosões, providenciando a remoção de seus ocupantes, compulsória se for o caso; V implantar sistemas de alerta e defesa civil, para garantir a saúde e segurança públicas, quando de eventos hidrológicos indesejáveis; VI proibir o lançamento de efluentes urbanos e industriais em qualquer corpo de água, nos termos do art. 208 da Constituição Estadual, e iniciar as ações previstas no art. 43 de suas Disposições Transitórias, isoladamente ou em conjunto com o Estado ou outros municípios da bacia ou região hidrográfica; VII Complementar, no que couber e de acordo com as peculiaridades municipais, as normas federais e estaduais sobre produção, armazenamento, utilização e transporte de substâncias tóxicas, perigosas ou poluidoras, e fiscalizar a sua aplicação; VIII prover a adequada disposição de resíduos sólidos, de modo a evitar o comprometimento dos recursos hídricos, em termos de quantidade e qualidade; IX disciplinar os movimentos de terra e a retirada da cobertura vegetal, para previnir a erosão do solo, o assoreamento e a poluição dos corpos de água; X condicionar os atos de outorga de direitos que possam influir na qualidade ou quantidade das águas superficiais e subterrâneas, em especial a extração de areia, à aprovação prévia dos organismos estaduais de controle ambiental e de gestão de recursos hídricos, fiscalizando e controlando as atividades decorrentes; XI exigir, quando da aprovação dos loteamentos, completa infra-estrutura urbana, correta drenagem das águas pluviais, proteção do solo superficial e reserva de áreas destinadas ao escoamento de águas pluviais e às canalizações de esgotos públicos, em especial aos fundos de vale; XII controlar as águas pluviais de forma a mitigar e compensar os efeitos da urbanização no escoamento das águas e na erosão do solo; ** XIII zelar pela manutenção da capacidade de infiltração do solo, principalmente nas áreas de recarga de aquíferos subterrâneos, protegendo-as por leis específicas, em consonância com as normas federais e estaduais de preservação dos seus depósitos naturais; XIV capacitar sua estrutura técnico-administrativa para o conhecimento do meio físico do território municipal, do seus potencial e vulnerabilidade, com vista à elaboração de normas e à prática das ações sobre uso e ocupação do solo, zoneamento, edificações e transporte; XV compatibilizar as licenças municipais de parcelamento de solo, de edificações e de funcionamento de estabelecimentos comerciais e industriais com as exigências quantitativas e qualitativas dos recursos hídricos existentes; XVI adotar, sempre que possível, soluções não estruturais, quando da execução de obras, de canalização e drenagem de água; XVII aplicar, prioritariamente, o produto da participação no resultado da exploração hidroenergética e hídrica em seu território, ou a compensação financeira, nas ações de proteção e conservação das águas, na prevenção contra seus efeitos adversos e no tratamento das águas residuárias; XVIII manter a população informada sobre os benefícios do uso racional da água, da proteção contra sua poluição e da desobstrução dos cursos de água. Parágrafo Único: Sem prejuízo das normas penais e ambientais aplicáveis, lei municipal estabelecerá sanções aos agentes públicos e aos particulares que, por ação ou omissão, deixarem de observar as medidas destinadas ao atendimento das disposições dos incisos IV e V deste artigo.
